1. Agreement to Terms
By accessing or using Sky Schedule at app.skyschedule.io ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Baumann Systems LLC, a limited liability company doing business as Sky Schedule.
2. Who Can Use the Service
The Service is intended for flight schools, FBOs, flight instructors, and their students. You must be at least 18 years old to create an account. By using the Service you represent that the information you provide is accurate and that you have the authority to bind any organization on whose behalf you are using the Service.
3. Accounts
You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at Ryan@skyschedule.info if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription and Payment
Access to Sky Schedule requires a paid subscription. Fees are billed in advance on a monthly or annual basis depending on your plan. All fees are non-refundable except where required by law. We reserve the right to change pricing with reasonable advance notice. Failure to pay may result in suspension of your account.
5. Acceptable Use
You agree not to use the Service to violate any applicable law or regulation, upload malicious code or attempt to compromise the platform, access another organization's data without authorization, reverse engineer or copy any part of the Service, or resell or sublicense access to the Service without written permission from us.
6. Flight School Responsibility
Sky Schedule is a software tool. We do not provide flight instruction, dispatch authority, airworthiness determinations, or regulatory compliance advice. Flight schools and operators are solely responsible for ensuring their operations comply with applicable FAA regulations and any other applicable law. Nothing in the Service constitutes legal, regulatory, or aviation safety advice.
7. Data and Privacy
Our collection and use of your data is governed by our Privacy Policy, which is incorporated into these Terms. You retain ownership of your data. By using the Service you grant us a limited license to store, process, and display your data solely to provide the Service to you.
8. Integrations
The Service integrates with third-party services including Stripe, QuickBooks Online, FlightAware, and others. Your use of those integrations is also subject to the terms and privacy policies of those third parties. We are not responsible for the availability or conduct of third-party services.
9. Intellectual Property
Sky Schedule, its software, design, and content are owned by Baumann Systems LLC and protected by applicable intellectual property law. These Terms do not grant you any rights to our trademarks, logos, or proprietary technology.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of security vulnerabilities. We disclaim all implied warranties including merchantability and fitness for a particular purpose.
11. Limitation of Liability
To the maximum extent permitted by law, Baumann Systems LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of data, revenue, or profits. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the three months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Baumann Systems LLC and its officers, employees, and agents from any claims, damages, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of any applicable law.
13. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. You may cancel your account at any time. Upon termination, your right to use the Service ceases. We will make your data available for export for a reasonable period following termination.
14. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Michigan.
15. Changes to These Terms
We may update these Terms from time to time. We will provide notice of material changes. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
